Adem\u00e1s, introduce nuevos elementos, como el derecho al olvido y el derecho a la portabilidad, que mejoran la capacidad de decisi\u00f3n y control de los ciudadanos sobre los datos personales que se conf\u00edan a terceros.<\/p>\n<p style=\"text-align: justify;\">Uno de los aspectos esenciales del Reglamento, ser\u00e1 lo que se conoce como responsabilidad activa de las empresas, con la nueva normativa, se entiende que actuar s\u00f3lo cuando ya se ha producido una infracci\u00f3n es insuficiente, dado que pueden causarse da\u00f1os a los interesados de muy dif\u00edcil reparaci\u00f3n o compensaci\u00f3n. Para ello, el Reglamento prev\u00e9 una bater\u00eda completa de medidas de protecci\u00f3n de datos desde el dise\u00f1o, la protecci\u00f3n por defecto, la realizaci\u00f3n de evaluaciones de impacto sobre la protecci\u00f3n de datos, y la promoci\u00f3n de c\u00f3digos de conducta y esquemas de certificaci\u00f3n\u2026<\/p>\n<p style=\"text-align: justify;\">La adaptaci\u00f3n de nuestra legislaci\u00f3n a este Reglamento comunitario hace necesaria la elaboraci\u00f3n de una nueva Ley Org\u00e1nica para evitar contradicciones, y las empresas deber\u00e1n revisar sus tratamientos de datos personales para adaptarlos a esas exigencias.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Se impulsa un anteproyecto de Ley Org\u00e1nica de Protecci\u00f3n de Datos para adaptar la legislaci\u00f3n espa\u00f1ola al Reglamento UE 2016\/679, antes de su aplicaci\u00f3n el 25 de mayo de 2018.
